1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you ("you," "Client") and T & J Construction & Electrical LLC ("we," "us," "our"), concerning your access to and use of the website and platforms of T & J Construction & Electrical LLC as well as any related construction, remodeling, or electrical services provided. You agree that by accessing our platforms or engaging our services, you have read, understood, and agree to be bound by all of these Terms and Conditions.
2. Intellectual Property Rights
Unless otherwise indicated, our platforms are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us. Project plans, specifications, and proprietary work methods developed by us remain our intellectual property, though the Client will have full rights to the completed work and final deliverables upon full payment as outlined in the applicable contract.
3. Service Provision and Payment
We agree to provide construction, remodeling, and electrical services as outlined in a separate contract, proposal, or Statement of Work (SOW). Service fees, payment schedules, material allowances, and project timelines will be specified in the signed agreement. Payments are due according to the schedule outlined. Failure to make timely payments may result in suspension or termination of work. Change orders for additional scope must be approved in writing before work proceeds.
4. Prohibited Activities
You may not access or use our platforms or our services for any purpose other than that for which we make them available. You agree not to interfere with job site safety, provide false information, or request work that violates applicable building codes or regulations. You are responsible for ensuring site access, permits where applicable, and any materials or documentation you provide to us are accurate and lawful.
5. Term and Termination
These Terms and Conditions shall remain in full force and effect while you use our platforms or engage our services. Either party may terminate the service agreement with written notice as specified in the contract or SOW. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION, DENY, SUSPEND, OR TERMINATE SERVICES TO ANY PERSON FOR ANY REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS.
6. Governing Law
These Terms shall be governed by and defined following the laws of the State of Missouri, USA. T & J Construction & Electrical LLC and yourself irrevocably consent that the courts of Christian County, Missouri shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
